Penalizing the Sex Worker or the Customer: French Policies on Prostitution

We studied in class the migrations and their influence on sexual work. This phenomenon, as complex as important, is a subject of debate and polemic within the political class. Concerning a badly known, and sometimes taboo, subject; prostitution remains a difficult domain to supervise effectively by the law. Connected to this subject, a law is going to be voted in 5 days in France. This draft law is an innovative initiative because it proposes the penalization of the customers instead of the prostitutes. This blog post will present the various opinions emitted on this subject, in a sociological aim towards the sexual workers.

At the origin of this project, there is an alarming report on the state of the prostitution in France. On 40,000 sex workers acting in France, 90% would be foreigners, victims of the sexual exploitation. The Minister of Women’s Rights, Najat Vallaud-Belkacem, particularly in favour of this law, has for ambition to remove the prostitution from France. To penalize the customers, with 6 months of detention and 7500 euros of fine, appears as a way to destroy the source of the prostitution: the demand. These arguments arise from the idea that the prostitution is very rarely chosen and generally undergone. Adopting a law like this would respect the principles of the Republic. Also it could destroy the financing of the mafias and so on destroy the traffic.

On the side of the opponents of this project, the arguments are not either lacking. “STRASS”, France’s sex workers union, is one of the main opponent. For them, such a law translates a moralistic ideology of the politicians. The abolition of prostitution, for them, seems to be an unattainable goal, furthermore such a law would damage above all the prostitutes. To penalize the customers would create an increase of the violence. Instead of trying to destroy mafia networks, such a law would only serve to stigmatize more the sexual workers. In the name of paternalists and puritans ideals, the politicians would prefer to attack the smoke rather than the fire. The failure of this kind of laws in Sweden and in Norway lets think the opponents that a regulation approach must be studied, rather that a stigmatizing one.

It is clear that both opposed camps have the same aim and objective: the abolition of the sexual slavery. Nevertheless, the evoked ways are subject to the controversy. In my humble opinion, the penalization of the customers will not destroy prostitution. Although I recognize moral virtues in this law, it is only disputing the expression of the problem and not its source. The foreign prostitutes would be the first victims of such a system. It is necessary to bring institutions (medical, judicial, economic) to them rather than to try to hide them. To penalize the customer would only “blur” the system, in the style of hostess bars in Japan. Try to legally distinguish deliberate prostitution from forced prostitution would be a first stage in the destruction of maffioso networks. Unfortunately trying to supervise legally the activities connected to human vices appears in our societies as a form of laxness. Seeing the reality such as it is would allow the improvement of our legal system, however it includes also to admit that prostitution cannot disappear.

Reconsidering Japan’s Denial of Dual Citizenship

An anonymous writer on the internet started her sentence with, “I am a Japanese mom and sold my son to France today.” The writer’s family has been living in France for 20 years, and she made her son acquire French citizenship so that he could  take state examination and receive state scholarship.

The writer said “people back home think we are no longer good patriots. But they cannot imagine how much we miss our home. The patriotism grows bigger when we live abroad.” Making a big choice, the mother wished Japan’s allowance of dual citizenship. She was scared that losing Japanese citizenship would have a negative effect on her son’s Japanese identity.

Having dual citizenship means that two countries recognize you as their citizen. Currently, Japan does not allow dual citizenship. Citizens of dual citizenship must choose one or the other before turning age 22. Japan is not an ethnically diverse country and Japanese government fears chaos the interferences of foreign human resources will bring. Allowance of dual citizenship will make many citizens to lose their patriotic heart toward Japan. Additionally, there are people who misuse and abuse dual citizenship to avoid certain laws or to request special admissions.

The reasons to not allow dual citizenship are reasonable. However, on the other side, global human resources and patriots will be lost due to inevitability of making a choice such as the case mentioned above. Japan in a need for further globalization could be helped by the globally raised children. As the Japanese child in France chose French citizenship, he will not come back to Japan and work for Japan; rather he will work for France. In these cases, Japan is not only losing a globalized future workforce, but also a citizen who could show nationalism. The possibility for this family to come back to Japan and live decreased, and there are many other families in the same situation.

Current Japan believes that there are more cons to pros in allowing dual citizenship. But is this true? Isn’t Japan losing other important things? Looking case by case, it is beneficial not only for the individual but for the nation to give some individuals dual citizenship. As the world is becoming smaller and a country can no longer stay as a pure nationalistic country, Shouldn’t Japan consider a way to benefit both the individual and the nation within the control of dual citizenship?

Multicultural Society and Multiculturalism in Europe

David Cameron criticized ‘state multiculturalism’ at a security conference in Munich, on February 5, 2011. In particular, he emphasized that it failed to promote a common identity based on certain values such as democracy, the rule of law and equal rights. Therefore, he claimed a stronger national identity was required to prevent violent extremism. Also, German Chancellor Angela Merkel and former president Nicolas Sarkozy of France identified with Mr. Cameron’s criticism of multiculturalism. Nowadays, Europe appears to be backing away from multiculturalism, particularly after the September 11 attacks.

With a growing influx of immigrants, multiculturalism was considered as a key to solve problems caused by policies based on assimilation and as a way to promote a harmonious relationship between host culture and immigrant culture. Many European countries conducted their immigration policy using multiculturalism as a way of new social integration. However, the trend of social ostracism against Islam and Muslim has developed connected to national security following a series of several terror attacks in 21C. Their culture and religion are not understood in a multiculturalist way, rather, people think they are at risk because of them. Also, some controversial issues have been brought up constantly since multiculturalism was introduced; whether young Arab women should be allowed to wear hijab in public school, how the honor killing or early marriage of some specific immigrant groups should be dealt with in host societies, and so on.

The question of how to integrate immigrants into a host country has always been a big issue. Neither assimilation nor multiculturalism provides a perfect answer. If assimilation is reinforced, isolation and dissatisfaction of immigrants who are not assimilated will become a social problem. European leaders who have declared multiculturalism will no longer support or focus on shared values and identities not their own cultural traits. However, it seems like they force such integration values from above. In this process, immigrants may experience frustration and exclusion from mainstream culture. On the other hand, if multiculturalism is too emphasized, people like Mr. Cameron think that it is divisive rather than unifying. Also, they argue that multiculturalism intrudes on the national identities of their countries. Therefore, it is important to harmonize the national policies of assimilation and multiculturalism.

What is the best way to integrate immigrants into host countries is the question for European society that needs to be sought constantly. The coexistence of cultures does not mean understanding each other’s culture unconditionally. Of course well-balanced immigration policy can promote coexistence, but social atmosphere that is respecting and compromising towards other cultures is also necessary. The beliefs of each culture should be respected as much as possible, and society needs to reach an agreement by communication and compromise whenever some parts are in conflicts with host culture.

French citizenship or the anti-communitarianism

By studying immigration in the United States, I noticed how much the vision of the migrants was different compared with France’s vision. The history of both countries being completely different, it seems that it influences the conception of the immigration. It seems interesting to compare sociologically these two ideologies as well as their result.

Countries as the United States, Australia or New Zealand built themselves thanks to the colonizing immigrants. This special past is important in the idea which these countries have of immigration: Immigration is always massive, wished, checked and presented as a strength. The multicultural society of the United States is described as a wealth, responding to a logic of market.

The public policies that control the immigration’s flow according to certain criteria: countries, languages, professional qualifications… This “chosen” immigration policy entails the creation of ethnic communities, sharing the same characteristics. In the US we can speak about South American, Asian or Black communities, which are themselves divided into an infinity of national or cultural communities. It is a large-scale communitarianism: the immigrants live parallel existences while sharing the same nationality.

European countries, in particular France, have a different immigration culture. Even if the number of immigrants is important (nearly 160,000/year), France sees the communitarianism as something bad, as a failure of the integration. Partially because this country is the heir of a long republican tradition, France pursues the dream of “republican messianism”: the French nation is one and indivisible: the origin, the color and the culture of an emigrant disappear since he becomes French. So the French state refuses to see ethnic communities on its territory, simply French citizens, without any other criterion of distinction.

To describe this ideal, Ernest Renan spoke about a “national project”, a nation based on the “will to live together”. However, today this myth seems unrealistic : it seems that the French nation, in spite of its historic will, does not integrate any more her immigrants as well as the native-born French people. Although the theory of the communitarianism is always refused by the political elite, ethnic groupings nevertheless built up themselves. The migrants, due to the lack of economic integration, live in the same poor suburbs areas. The myth of a “French-style” citizenship collapsed: the secularism loses its sense when the school holidays are based on the Christian calendar while in certain high schools the majority of the students are Muslim.

France always ideologically refused the creation of subgroups within the French citizenship, however it turns out that the economic reality does not allow any more the same integration for all.

To convince itself, it is enough to look at the exam’s results of the Parisians elite’s high schools compares to the very close high schools, considered as difficult, where the students are mainly sons of immigrants. Not recognizing communitarianism doesn’t makes it disappear, quite the contrary.

The Issue of Migrants in the EU

Do you know “Roma”? Not Rome, but Roma. It might be confusing, so I write it as “Romani”. Romani are an ethnic group living mostly in Europe. They are also called and known as “Gypsies”, maybe you have been heard that word. In 2007, the EU expanded in Central Europe, and as you know Bulgaria and Romania also have joined the EU. At the same time, we are recognizing that the Romani of 9 million constitute a “Fourth World” in the area. Moreover, Romani living in the EU are forced to survive the life in lower than standard necessary to still maintain human dignity.

Rumanian and Bulgarian of the Romani native place come over to the French city and suburbs, and they set up camping as the temporary house at there. In addition, most of them have not received school education and become the victim of  human trafficking networks. Such networks let elderly person and children beg by the roadside and forces daughters to prostitution and expands by doing an illegal act. Much camping was removed by a policy of the French Government, and the Romani of several hundred returned to Romania independently. However, this let the EU highlight a problem of “freedom of movement” written in the Treaties of the European Union. However, France is a country making much of “freedom of movement” from other countries because of experience shut in the other side of the Iron Curtain. Therefore France supported Bulgaria and EU participation of Romania at the very beginning.

However, since the freedom of the movement is valuable simply, France wants to take measures to prevent the crime network taking advantage of the poverty of Romani. This is what written down in EU treaty Article 3, and it means that the freedom of movement is not unlimited and this is carried out on one of the cooperation with “destruction measures criminal with prevention of crime”. In other words, the freedom of movement can never become the large-scale emigrant incurrent excuse.

Afterwards, France visited to Romania and agreed that both found a solution jointly. From there, the French thought, it is the most important that Romania and Bulgaria take responsibility for the own nation, since EU member states have a duty to protect the nation from own country. It is written down in Treaties of the European Union Article 2.

This problem is world and our problem not just a problem of the whole Romania, France and EU now. Most of people are irresponsibility about the issue of emigrant, however it is same to what add a new chapter to the sad history of the emigrant who has been oppressed. So I will be glad if even slightly many people are interested about the issue of emigrant by reading my blog post. Thank you.
